These Terms of Use (the “Guest Terms”) are a legally binding agreement between you (the individual accessing our websites, booking, requesting, arranging, or using the Services, including on behalf of another person) and Freelancer LLC®, including its parents, subsidiaries, affiliates, representatives, officers, directors, and agents (“Freelancer,” “we,” “us,” or “our”).
These Guest Terms govern your access to and use of our websites, pages, accounts, communications, and any related offerings, features, technology, and platforms (collectively, the “Platform”), and your use of or interaction with any transportation services arranged through the Platform (the “Services”).
IMPORTANT — ARBITRATION & CLASS ACTION WAIVER (U.S.):
Section 12 contains an arbitration agreement and class action waiver.
Please read it carefully. It affects your legal rights and how disputes are resolved.

1. Definitions
- “Platform” means our websites, booking pages, forms, support channels, and any related technology used to request, schedule, pay for, or manage Services.
- “Services” means chauffeured transportation and related services arranged through Freelancer.
- “Chauffeur/Provider” means the independent driver or transportation provider who performs the ride or service.
- “You” / “Guest” means the person using the Platform or arranging travel for themselves or others.
2. Our Role (Marketplace / Arrangement Services)
Freelancer provides an intermediary platform that enables Guests to request, schedule, and pay for chauffeured transportation performed by independent Chauffeurs/Providers.
Unless explicitly stated otherwise in writing, Freelancer is not the motor carrier providing the transportation and does not directly operate vehicles for every trip. Chauffeurs/Providers are generally independent contractors and are not employees, agents, or partners of Freelancer for purposes of providing the ride.
Freelancer’s role includes, for example: facilitating booking, dispatch coordination, communications, receipts, customer support, and payment processing.
3. Eligibility and Accounts
You may use the Platform only if:
- You can form a legally binding contract under applicable law; and
- You are at least 18 years old.
You are responsible for all activity under your account, including bookings made on behalf of others. You agree to provide accurate information and keep it current. Freelancer may restrict, suspend, or terminate access if we reasonably believe your account activity is fraudulent, unsafe, or violates these Guest Terms.
4. Booking Requests, Trip Details, and Guest Responsibilities
When you request or book Services, you agree to:
- Provide accurate pickup and destination details, passenger count, and requested time;
- Ensure passengers comply with safety rules and lawful conduct;
- Be available for pickup and reachable for coordination (phone/email/WhatsApp where applicable);
- Treat Chauffeurs/Providers and property with respect.
Special requirements (e.g., large luggage, multiple stops, accessibility needs, child seats, or special instructions) must be disclosed at booking. Availability may vary.
No medical transport / no emergency services: Our Services are not medical transportation. If you have an emergency, call 911.
5. Pricing, Charges, and Payments
5.1 Charges
You agree to pay the amounts shown at booking or otherwise communicated to you (“Charges”), which may include base fare, airport fees, tolls, parking, wait-time, stops, surcharges, cleaning/damage charges, administrative fees, or taxes where applicable.
5.2 Payment Methods
We may accept payments via credit card, debit card, PayPal, and other methods we enable. By providing a payment method, you represent you are authorized to use it.
5.3 Authorization and Receipts
You authorize Freelancer (and our processors) to charge your payment method for Charges, including permitted post-trip adjustments (e.g., additional wait-time, tolls, approved changes, or verified damage/cleaning).
5.4 Disputed Charges / Chargebacks
If you dispute a charge, contact us first at support@freelancedrivers.com. Improper chargebacks, fraud, or abuse may result in booking restrictions, account suspension, or refusal of service.
6. Cancellations, No-Shows, and Changes
Your booking may be subject to our Cancellation / No-Show Policy, which may include fees based on timing, chauffeur dispatch status, and operational costs. Policy terms may be posted on our site or provided during booking.
Changes (pickup time, stops, route, passenger count) may affect pricing and availability.
7. Gratuities; Vehicle Damage and Cleaning
Gratuities may be included, optional, or not included depending on the booking terms presented at checkout. If optional, you are free to tip, but not required.
You are responsible for damage beyond normal wear, excessive cleaning, bodily fluid cleanup, smoking-related remediation, or other verified issues caused by you or your party. Where permitted, you authorize charging your payment method for verified costs.
8. Guest Conduct and Safety
You agree not to:
- Harass, threaten, assault, or discriminate against any person;
- Damage vehicles or property;
- Engage in illegal activity during or in connection with Services;
- Attempt to interfere with driving or safety procedures;
- Use the Platform for unlawful, abusive, or fraudulent purposes.
Chauffeurs/Providers may decline or terminate a trip if they reasonably believe safety is at risk, unlawful conduct is occurring, or policies are being violated.
9. Right to Refuse, Cancel, or Limit Service
To protect safety, prevent fraud, and maintain service quality, Freelancer reserves the right (where permitted by law) to refuse, cancel, limit, or terminate Services or Platform access for reasons including, without limitation:
- Suspected fraud, payment risk, or chargeback abuse;
- Threatening, harassing, unsafe, or illegal conduct;
- Policy violations or misuse of promotions/loyalty benefits;
- Operational infeasibility or safety concerns.
We do not refuse service on unlawful discriminatory grounds. California’s civil rights protections apply to business establishments.
10. Privacy and Communications
Your use of the Platform is also governed by our Privacy Policy, Cookie Notice, and Do Not Sell or Share My Personal Information (California) page (collectively, “Privacy Notices”). These describe how we collect, use, and share information.
You consent to receive communications related to your bookings and account via phone, email, or messaging platforms you use to contact us (including WhatsApp, where applicable). You can opt out of promotional messages as described in the Privacy Notices.
11. Intellectual Property and Acceptable Use
All content and materials on the Platform (text, graphics, logos, interfaces, and software) are owned by or licensed to Freelancer and protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or exploit Platform content except for your personal, non-commercial use as permitted by these Guest Terms.
You may not:
- Reverse engineer or attempt to extract source code;
- Scrape, spider, or use automated tools without permission;
- Circumvent security features;
- Introduce malware or attempt unauthorized access.
12. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER (U.S.)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
12.1 Informal Resolution First
Before filing a claim, you agree to attempt to resolve disputes informally by contacting us at:

- Your name
- Booking email/phone
- Trip date (if applicable)
- Brief description of the issue
- Requested resolution
We will attempt to resolve disputes in good faith. The statute of limitations will be tolled during good-faith informal resolution for up to 60 days unless extended by mutual agreement.
12.2 Agreement to Arbitrate
Except as described in Section 12.5, you and Freelancer agree that disputes arising out of or related to these Guest Terms, the Platform, or Services will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules.
This arbitration agreement is governed by the Federal Arbitration Act (FAA).
Location / Format: Arbitration may be conducted by video, telephone, or written submissions for lower-value disputes unless the arbitrator determines otherwise.
12.3 Waiver of Jury Trial
You and Freelancer waive any right to a trial by judge or jury for covered disputes.
12.4 Class Action Waiver
All disputes must be brought individually. You and Freelancer waive the right to participate in any class, collective, or representative proceeding to the maximum extent permitted by law.
12.5 Exceptions (Not Covered or Optional)
- Small claims matters eligible for small claims court (as long as the claim remains there)
- Claims not arbitrable under applicable law
Sexual assault / sexual harassment: Where applicable, the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act permits claimants to choose court rather than mandatory arbitration.
12.6 California Fee-Payment / Default (SB 707 Notice)
If California law applies and required arbitration fees are not paid within required timelines, California statutes may provide remedies including default and waiver of the right to compel arbitration.
12.7 Arbitration Opt-Out (Optional)
You may opt out of arbitration by sending an email within 30 days of accepting these Guest Terms to:
Subject: “I opt out of arbitration”
Include your name and booking email/phone. Opting out does not affect other terms.
13. Disclaimers
THE PLATFORM AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
To the maximum extent permitted by law, Freelancer disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Freelancer does not guarantee:
- Availability of Service at any given time or location
- Exact pickup or arrival times
- Uninterrupted third-party platforms or communications tools
14. Limitation of Liability
To the maximum extent permitted by law, Freelancer will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages (including lost profits or data), even if advised of the possibility.
Total liability will not exceed the greater of:
- The amount paid for the relevant booking in the previous 12 months, or
- $1,000 USD
Nothing limits liability that cannot legally be limited.
15. Indemnity
You agree to indemnify and hold harmless Freelancer and affiliates from claims, damages, losses, liabilities, and expenses arising from:
- Misuse of the Platform
- Violation of these Guest Terms
- Violation of law or third-party rights
- Damage or harm caused by you or your party
16. Force Majeure
Freelancer is not liable for delays or failures caused by events beyond reasonable control including natural disasters, severe weather, strikes, war, terrorism, governmental actions, pandemics, civil unrest, outages, or road closures.
17. Suspension, Termination, and Access Restrictions
We may suspend or terminate access to the Platform or Services for policy violations, fraud risk, safety concerns, or other lawful reasons. Sections intended to survive termination will remain in effect.
18. Changes to These Guest Terms
We may update these Guest Terms from time to time. Updates become effective upon posting with a revised “Last Revised” date. Continued use of the Platform constitutes acceptance.
19. Governing Law and Venue (If Not Arbitrated)
These Guest Terms are governed by the laws of the State of California.
If not subject to arbitration, disputes will be brought in state or federal courts located in Orange County, California unless required otherwise by law.
